This Personal Data Privacy Policy ("the Privacy Policy") illustrates the practice of Fairwood Fast Food Limited ("Fairwood" or "We" or "Us" or "Our") in relation to your personal data ("Data") we collect from you through (a) Fairwood’s mobile application ("Fairwood App"); (b) our websites and/or online services, including http://www.fairwood.com.hk, https://fairwood.order.place, https://order.fairwood.com.hk and any other owned or operated websites, social media platforms and/or online services that link to the Privacy Policy (collectively the "Sites"); (c) our hotline, e-mail, Instant Messaging Applications or post communication with us; (d) order-placing in store or via phone; (e) any application or request submission to us. Any reference to "You" and "Your" when used in the Privacy Policy includes any person who accesses the Fairwood App and/or Sites and/or submits Data via any means as mentioned above. Please read through the Privacy Policy carefully. By using the Fairwood App and/or the Sites or submitting Data via any means as mentioned above to us, you agree to accept the Privacy Policy. We have the right to change or amend the Privacy Policy at any time without prior notice. Any changes or amendments will be posted on the Fairwood App and/or the Sites. You are advised to check it on a regular basis. By continuing to use the Fairwood App and/or Sites and/or participate the membership program managed and operated by Fairwood (the "Membership") and/or place order and/or submit application/request to us and/or submit Data to us via any means as mentioned above after the Privacy Policy is changed or amended, you are deemed to have consented to such changes or amendments.

1 Personal Data (Privacy) Ordinance

1.1

In collecting, using, storing, retaining, disclosing, transferring, providing, allowing access to, protecting and accessing Data, we shall comply with the requirements of the Personal Data (Privacy) Ordinance (Chapter 486 of the Laws of Hong Kong SAR) (the "Ordinance"). 

2 Collection of Data and Information

2.1

When you use the Fairwood App and/or the Sites and/or participate Membership and/or place order and/or submit application/request to us and/or submit Data to us via any means as mentioned above, we may collect Data including but not limited to your name, address and/or delivery address, JoyYou Card number, photo and/or image, telephone/mobile phone number, birthday month, gender, billing information (electronic payment and/or credit card and/or bank account details, if you place an order with us for our goods or services), email address, location, social media accounts related information used for logging in member account, IP address, operating system type, browser type, domain name, access time and other information relating to other persons relevant to the information or services you have requested, from you which will be used as follows: (a) for verification of identity and record for the purposes of recruitment providing goods and services and/or customer services; (b) to fulfill your order for goods or services and processing of such order, payment and any outstanding amounts; (c) to store contact details in our internal database; (d) to generate surveys on user traffic on the Fairwood App and/or Sites; (e) to respond to and process any query from you or fulfill requests submitted by you; (f) for evaluation and further enhancement of our goods and services; (g) for direct marketing and/or conducting market surveys, research or analysis relating to our customers, goods, services, activities, promotions or events; or (h) to administer, operate, participate in, interact, partner or collaborate with Membership and/or customer loyalty programs, including but not limited to Membership profiles and Membership benefit.

2.2

You acknowledge and agree that the provision of your Data to us is voluntary.

2.3

You may request to access, update, correct or delete your information, your preference with regard to the information and materials you received from us or our use of your Data by sending Personal Data Access/Correction/Deletion Request Form ("the Request Form") to our Customer Services Department ("CSD") via email to cs@fairwood.com.hk or by post to 2/F, TRP Commercial Centre, 18 Tanner Road, North Point, Hong Kong marked to the attention of CSD. To the extent permitted under the Ordinance, Fairwood may charge a reasonable fee for handling relevant request.

3 Use of Data for Direct Marketing

3.1

We intend to use your Data for purpose of direct marketing by sending you the direct marketing communications, such as mail, email, telephone and SMS containing news, offers and promotions on food, beverage, catering products, services and "Membership". We shall not use your Data for such purpose unless we have obtained your consent.

3.2

We are not allowed to provide your Data to any third party for direct marketing purposes without your written consent.

3.3

If you do not wish to receive any direct marketing communications from us, irrespective of whether you have participated the Membership or you have given your consent to us, you may update your preference in Fairwood App, the Sites, Instant Messaging Applications (in case you provided Data to us via this means) or send the Request Form to CSD via email at cs@fairwood.com.hk or post to 2/F, TRP Commercial Centre, 18 Tanner Road, North Point, Hong Kong marked to the attention of CSD indicating your request to cease using your Data for direct marketing purpose by us. We shall cease to use your Data for direct marketing purpose within 1 month from the date of receipt of your complete request.

4 Security

4.1

We will use reasonable security technologies and procedures to protect the Data from unauthorized access, use or disclosure. However, due to the nature of the Internet and technology, it is possible that others may intercept the information you are sending to or transmitting through the Fairwood App and/or the Sites. We do not warrant that the Fairwood App and/or the Sites are impenetrable or invulnerable to hackers.

5 Disclosure, Retention and Storage of Data

5.1

You acknowledge, agree and authorize us to retain and store the Data in one or more of our databases within or outside Hong Kong.

5.2

Except with your prior consent or as permitted by law, we will not transfer, disclose, provide or allow access of your Data to any third party except as stated below:
(a) Fairwood Holdings Limited (being our parent company), together with its subsidiaries;
(b) our employees;
(c) credit companies for payment transactions;
(d) any person or organization to whom we are required to make disclosure to (i) in accordance with the requirements of applicable laws, court orders, administrative policies or regulations, guidelines or directives, (ii) orders given or issued by any regulatory, governmental, tax, law enforcement, other authorities, self-regulatory or industry bodies in or outside Hong Kong, (iii) in connection with any legal proceedings or (iv) for establishing exercising or defending legal rights in Hong Kong;
(e) any person, organization or entity for the purpose of conducting due diligence in connection with our business, merger, acquisition or transfer of business;
(f) any person, organization, entity or authority to facilitate identification of an individual involved in a life threatening or emergency situation; or
(g) any agent, contractor or third party service provider who provides operation, research, sale, data analysis and processing, computer technology, telecommunication, telemarketing, payment or other services in connection with our business operation, provision of our goods and/or services and Membership management and operation.
You acknowledge, agree and authorize us that we may transfer, disclose, provide or allow access your Data to execute, implement or comply with any term of our Terms and Conditions or the Privacy Policy.

5.3

Fairwood shall not keep your Data longer than is necessary for fulfilment of the purposes specified above for which they are, or are to be, used.

5.4

Data provided by you is retained if the purpose for which the Data was collected still exists, it is so required by law, statute or regulation, or it is in the public interest.

6 Data Access, Correction and Deletion

6.1

You are entitled to check whether we hold Data about you and to access any such Data, and if applicable, to require us to correct any inaccurate Data or update it. If you wish to access, correct or update your Data, please make a data access and/or correction request via submitting the Request Form to CSD via email cs@fairwood.com.hk or post to 2/F, TRP Commercial Centre, 18 Tanner Road, North Point, Hong Kong marked to the attention of CSD. We will endeavour to respond within 1 month of your complete request, provided that we have received sufficient information to verify your identity.  To the extent permitted under the Ordinance, Fairwood may charge a reasonable fee for handling relevant request. You may also change correct or update name, gender, address and/or password via the Fairwood App and/or the Sites for your Membership.

6.2

If you wish to withdraw from Membership and/or request for removal or deletion of your Data, you may delete your member account in Fairwood App or submit your instruction/request by sending the Request Form to CSD via email cs@fairwood.com.hk or post to 2/F, TRP Commercial Centre, 18 Tanner Road, North Point, Hong Kong marked to the attention of CSD. We shall remove or delete your Data within 1 month from the date of receipt of complete instruction/request, provided that we have received sufficient information to verify your identity.

7 Cookies

7.1

We may use cookies on the Fairwood App and/or the Sites. Cookies are small bits of information that are automatically stored by a website or mobile application on a person's web browser in his/her computer or device that can be retrieved by that website or mobile application. The information collected by cookies is anonymous aggregated research data, and contain no name or address information or any information that will enable anyone to contact you via telephone, email or any other means. Most browsers are initially set up to accept cookies. Should you wish to disable those cookies you may do so by changing the settings on your browser. However, as cookies are necessary for some features of the Fairwood App and/or the Sites to work, e.g. to maintain continuity during a session, if they are disabled, those features may not work properly and this may cause some of our webpages to display incorrectly or not at all.

8 Minors

8.1

We are not obliged to check or verify your age and assume that you are the age of 18 or above. If you are under the age of 18 or do not have the ability to enter into a contract, you should not provide any Data on the Fairwood App and/or the Sites and/or store/phone order-placing and/or application/request and/or via any means as mentioned above without prior consent from your parents/guardians. Parents/guardians are advised to monitor their children/minors when they are online.

9 General

9.1

In case of any conflict or inconsistency between the English and Chinese versions of the Privacy Policy, the English version shall prevail over the Chinese version (which is provided for information purposes only).
